How easy or difficult is it to maintain good faith in negotiation? What are the obstacles that a mediator faces while trying to understand all parties involved in the bargaining process?

In this article I wrote recently, I focused on the importance of good faith and fair dealing in contract law, as highlighted in the Maltese Civil Code.

As expressed in the article which can be downloaded in full by clicking on the ‘download’ button below, an integral part of such negotiation is mediation, as it involves the intervention of an acceptable third-party who has limited or no authoritative decision-making power.

Although mediation is important, the problem with it is that it involves personalities on both sides who think the same, that is the other side is negotiating in bad faith, which might eventually lead to distractions from the actual negotiation.
