For anyone considering employing new foreign workers, the move to Malta on an employment basis is not straight forward and so quick. Following certain procedure to obtaining proper documentation is a necessary step. The Expatriates Unit at Identità plays a crucial role in facilitating the legal migration process, handling the processing and issuance of residence documentation for both EU and non-EU nationals.

EU citizens enjoy the freedom to reside and work in Malta without needing a permit, provided they engage in activities covered by their treaty rights, such as employment, self-employment, family reunification, or education.

However, non-EU nationals, including British citizens and Third Country Nationals (TCNs), must meet specific criteria to relocate to Malta, primarily for employment purposes, which is the most common reason for relocation. For those who aren’t Maltese or EU citizens, obtaining a Single Work Permit in Malta is imperative before starting work in the country.

Employers in Malta face significant hurdles in the recruitment process, particularly in attracting local talent and hiring TCNs from abroad. This challenge is particularly pronounced for companies without dedicated HR or administrative support.

The process for obtaining a Single Work Permit involves several stages and navigating these processes can be time-consuming and complex due to paperwork and coordination with various entities. To alleviate this burden, our dedicated admin team offers professional assistance with residency documentation and Single Work Permits, including applications for Key Employee Initiative (KEI) and Specialist Employee Initiative (SEI).

The process starts with identifying a suitable candidate and establishing terms, followed by crafting a detailed job description and formalising the work contract. Subsequently, the employer must complete necessary application forms, including submitting accompanying documents such as passport copies, certificates, reference letters, and CVs. Once this is done, the application is initiated through the online portal. Afterward, the application undergoes review for accuracy and completeness, and upon verification, the applicant receives an approval in principle letter, allowing them to apply for a travel visa to Malta. Following the visa application at the nearest Maltese Embassy/Consulate, which may entail meeting specific requirements including attending interviews, the applicant can travel to Malta. However, before employment can commence, obtaining a Maltese residence card is necessary, involving the submission of essential documents such as a valid visa, lease agreement, declaration form, proof of health insurance, medical test results, signed health form, and Jobsplus engagement form.

In terms of Key Employee Initiative (KEI) applications, this offers a streamlined process designed for highly specialised TCNs seeking employment in Malta. Eligible candidates must possess the required qualifications and earn an annual gross salary of no less than €35,000. On the other hand, the Specialist Employee Initiative (SEI) applications is tailored for highly skilled TCNs who may not qualify for the KEI program. This accelerated service requires applicants to demonstrate relevant academic, vocational, or technical expertise and secure an annual gross salary of at least €25,000.

We know all these processes can be quite overwhelming and time consuming, as it involves a lot of paperwork, chasing, organising and applying with different entities.
