What Employers and Applicants Need to Know on Malta’s 2025 Labour Migration Policy Updates.

Malta’s labour landscape has undergone major changes this year. Following the reform of the Labour Migration Policy, a series of updates will come into force in 2025, first on 1st August, and then further amendments on 1st October. These updates will significantly impact how employers recruit, manage, and support third-country nationals (TCNs).

For employers, HR teams, and services providers involved in work permit applications, understanding these changes is essential to remain compliant and ensure a smooth process for both clients and candidates.

Key Policy Changes Effective 1st August 2025

Stricter Vacancy Advertising Requirements

Employers seeking to hire TCNs who are abroad or applying for their first single permit must:

  • Advertise the vacancy for at least three weeks within the two months prior to submitting the application.
  • Publish the advert on an appropriate local media platform, clearly displaying the full date of publication.

Exemptions:

  • KEI, SEI, EU Blue Card applicants, and roles on the Skilled Occupation List require only a two-week advert.
  • Full exemptions apply to:
    • Health sector roles
    • Elderly and disability care
    • Student workers
    • Applicants recommended by authorities such as Malta Enterprise
    • Sportspersons

Incorrect or insufficient advertising will render applications ineligible, leading to delays or rejection.

Updated Residence Permit Application Fees

From 1st August:

  • First-time Single Permit: €600
  • Permit Renewal (yearly): €150
  • Change of Employer: €600
  • Change of Designation: €300
  • Health and care sector roles: Flat fee of €150 for all applications

New Salary Thresholds for KEI and SEI

  • Key Employment Initiative (KEI): €45,000 annual gross salary
  • Specialist Employment Initiative (SEI): €30,000 annual gross salary

Extended Grace Periods for Terminated Workers

Single Permit holders whose employment ends will benefit from:

  • A 30-day grace period to remain in Malta and find new employment
  • A possible extension to 60 days with proof of financial self-sufficiency

Key Policy Changes Effective 1st October 2025

Mandatory Electronic Salary Payments

From 1st October, salary payments for newly engaged TCNs must be made exclusively through licensed financial institutions.

  • Cash payments will no longer be recognised as fulfilling contractual obligations.
  • This requirement applies to all TCNs whose employment is registered from 1st October onwards.

Interim Permits for TCNs from Visa Waiver Countries

TCNs originating from visa waiver countries will face new rules:

  • Applicants who apply for a single permit within 60 days of entering the Schengen Area will be eligible for an interim permit, allowing them to remain in Malta during processing.
  • Applicants applying between 61 and 90 days after entry must wait outside the Schengen Area for the application outcome.

Enhanced Support for Victims of Human Trafficking

TCNs identified as victims of trafficking and applying under S.L. 217.07 will now benefit from:

  • Exemption from all application fees
  • Residence permits valid for one year (up from six months)
  • Renewals permitted for the full duration of related court proceedings
